Welcome To Heymory! Where Every Moment Is Celebrated. We Want To Develop Services And Technologies That Enable You To Share And Preserve Your Memories With Friends. To Make This Possible, We Want To Make It Particularly Clear What It Means To Be Part Of The Heymory Community. We Want You To Know What To Expect From Us, What We Expect From You, And How Together We Can Make Heymory Better For You And Your Friends. For This Purpose, We Have Created These Terms Of Use (“Terms”) And Our Privacy Policy. Throughout The User Agreement, Some Words Have Specific Meanings And Should Be Interpreted In The Same Manner Wherever They Are Used. If Something Is Unclear Or You Don't Understand What We Are Saying, Please Do Not Hesitate To Contact Us. Our Goal Is To Maximize Transparency And Understanding Of How Heymory Works. So Please Read It. If You Do Not Want To Read Or Agree To The User Agreement, Then Do Not Use Our Services, But If You Use Our Services, You Understand That You Agree To Be Bound By The User Agreement.

Our Services Include All Aspects Of The Heymory Mobile Applications, Our Website (Https://Heymory.Com/), And The Software And Systems That Operate The Applications And Our Website. To Use Our Services, You Must Be A REAL Human Being At Least 13 Years Old. If You Are Under The Age Of Majority In Your Country, Depending On Where You Live, A Parent Or Guardian May Also Need Consent For You To Use Our Services; Or Must Have The Legal Authority To Create An Account On Behalf Of Another Person, Company, Organization, Government, Or Other Legal Entity If You Are Not Creating An Account For Yourself. All References To "You" And "Your" In The User Agreement Mean Both You, The End User, And Accounts Created On Behalf Of Another Person, Company, Organization, Government, Or Other Legal Entity, To The Person Legally Authorized To Create And/Or Operate The Account.

You Own The Content That You Share Through Our Services And Grant Heymory A License To Use The Content Under The Following Conditions: Friends Only Private Content Is Content That You Share Only With Your Friends On Heymory. Private Content That You Do Not Share With Anyone Other Than Yourself On Heymory. In Consideration For Your Use Of Our Services, You Grant Us A Worldwide, Non-Exclusive, Royalty-Free And Sublicensable License To Use, Copy, Reproduce, Edit, Adapt, Modify, Publish, Transmit, Display And Distribute The Content You Share With Your Friends , In All Media And Distribution Methods. This License Authorizes Us To Make Your Private, Friend-Only Content Available To The Rest Of Your Friends And To Allow Others To Do The Same. Heymory Takes No Responsibility And Will Not Be Liable For Any User Content Posted, Stored Or Uploaded By You Or Any Third Party Or For Any Loss Or Damage Resulting Therefrom. You Use Our App At Your Own Risk. As A Service Provider, Heymory Is Not Liable For Any Statements, Representations Or User Content Provided By Its Users In Any Storage Area, Personal Homepage Or Other Interactive Area.

Heymory Has No Obligation To Review, Edit Or Monitor Any User Content Posted In Any Storage Area, Heymory Reserves The Right, And Has No Absolute Discretion, To Delete Any User Content Posted Or Stored On The Site At Any Time And For Any Reason Without Prior Notice To You, And You Are Solely Responsible For Backing Up And Replacing, At Your Expense, Any User Content That You Post Or Store On The Site. Any Use Of The Interactive Areas Or Other Parts Of The Website In Violation Of The Foregoing Constitutes A Breach Of These Website Terms And Conditions And May Result In, Among Other Things, Termination Or Suspension Of Your Rights To Use The Interactive Areas And/Or The Website . Name, Email Address, Etc.), IP Addresses And Traffic Information, Usage History And Posted User Content. Heymory's Right To Share Such Information Takes Precedence Over Any Provisions Of The Heymory Privacy Policy To The Contrary.

We Have No Obligation To Monitor The Content That People Share On Our Services. However, We Want Our Services To Be A Place Where People Can Have Their Private Space And Feel Safe. Content That Violates Another Person's Rights Or Does Not Comply With Any Law, Rule, Regulation Or The User Agreement ("Infringing Content") Is Prohibited. If You See Any Violative Content, You Can Report It To Us Via Our Email. Because All Memories Are Private And We Do Not View Shared Content, We May Temporarily Or Permanently Suspend Your Account And Prevent You From Using Our Services If We Determine That You Have Shared Infringing Content Or Used Our Services In A Way That Violates The Rights Of A Violates Another Person Or Does Not Comply With Any Laws, Rules, Regulations Or The User Agreement. This Means That If You Share Infringing Content, We Will Suspend Your Account For 30 Days, During Which You Will Not Be Able To Share Content Or View Other Content On Our Services. If This Happens 3 Times, You're Out! We Will Permanently Ban You From Our Services And Prevent You From Creating A New Heymory Account. Please Note That Certain Violative Content (E.G., Child Sexual Abuse Material (CSAM)) Will Result In Your Immediate And Permanent Suspension From Our Services. To Protect You, Other Users, And Our Services, We May Temporarily Suspend Your Account If We Detect Abnormal Activity That May Pose A Technical Or Security Risk To You, Other Users, Or Our Services. You Can Delete Your Account At Any Time By Going To Your Account Settings And Selecting The Option To Delete Your Account.

Our Services Are Protected By Copyright, Trademark, Trade Secret, And Other Laws Throughout The World. As Tempting As It May Be, Nothing In The User Agreement Gives You The Right To Use The Heymory Name Or Any Of The Heymory Trademarks, Logos, Domain Names, Other Distinctive Brand Features And Other Proprietary Rights. While You Use Our Services, Heymory Grants You A Personal, Worldwide, Royalty-Free, Non-Transferable And Non-Exclusive License To Use The Software Provided To You As Part Of Our Services. This License Has The Sole Purpose Of Enabling You To Use And Enjoy Our Services In Accordance With The User Agreement. This License Terminates When You Stop Using Our Services. Heymory Is Free To Use Any Feedback, Comments Or Suggestions You Provide Regarding Our Services.

By Using Our Services, You Agree That The Liability Of Heymory, Its Subsidiaries, Affiliates, Officers, Directors, Employees, Agents, Partners And Licensors Shall Be Limited To The Maximum Extent Permitted In Your Country Of Residence.

To The Extent That These Terms Permit You Or Heymory To Bring Litigation In A Court, Both You And Heymory Consent To The Exclusive Jurisdiction Of The German Courts And German Law. You And Heymory Agree That All Claims And Disputes (Whether Contractual Or Otherwise) Arising Out Of Or In Connection With The Terms Of Use Or The User Agreement Will Be Litigated Exclusively In German Courts And That Such Disputes Will Be Governed By German Law, Unless Because, This Is Prohibited By The Laws Of The Country In Which You Reside.

Heymory May Update The User Agreement At Any Time. If We Make An Update That Affects The Rights Or Obligations Of Either Party, We Will Notify You Approximately 30 Days Before The Update Takes Effect. If You Continue To Use Our Services After 30 Days, You Agree To The Updated User Agreement. If You Do Not Wish To Consent, You Must Stop Using Our Services. If Any Part Of These Terms Or The User Agreement Is Found To Be Unenforceable, All Other Provisions Will Continue To Apply. The User Agreement Exists Between You And Heymory, Based In Düsseldorf, Germany.
